With regular heavy traffic conditions on the New York roads, it is not uncommon for traffic to slow down at times. When a driver travels at a high rate of speed and fails to keep a safe distance from other vehicles, a car accident is likely to happen. A driver whose attention is distracted for only a moment could collide with another vehicle in the blink of an eye.

Seneca County, NY

The New York State Police reported attending to such an accident in Seneca County on a recent Thursday morning. An initial investigation found that a 72-year-old man and his 62-year-old female passenger were westbound on the Thruway when the traffic slowed down. A 29-year-old driver, who was apparently not driving at an appropriate speed for the conditions and was also not maintaining a safe following distance smashed into the back of the elderly driver’s vehicle.

The 72-year-old driver suffered serious injuries and was taken to a medical center by helicopter. Sadly, the impact of the crash killed his passenger, and she was declared dead at the accident scene. Troopers reported that the impact caused the vehicle that was rear-ended to hit another car in front of it. The driver of the first vehicle who is suspected to have been at fault was charged with following too close to the traffic ahead of him and failing to travel at a safe speed.

The Right to File a PI Claim

Any New York resident who has been the victim of a car accident that was caused by the negligent driving of another party retains the right to file a personal injury in a civil court. Similarly, those who have lost loved ones in such circumstances may file a wrongful death claim. Any monetary judgment that may be awarded could provide assistance in covering medical and/or end-of-life expenses, as well as other financial losses recognized by our courts, that were brought about by the accident.
