Tragedy struck Fort Greene, Brooklyn on Nov. 2 when a car struck several pedestrians after leaving the road. The fatal accident claimed the life of a 9-year-old boy and injured three other people, according to New York police arriving on the scene. No criminal charges have been filed in association with the accident, but the investigation is ongoing.

According to witnesses, an SUV driven by a 59-year-old man was traveling west and was attempting to negotiate a left-hand turn when his vehicle was struck from behind by another car. The force of the impact forced the SUV from the road and onto the sidewalk where it struck several pedestrians. It is suspected the SUV driver was attempting to avoid striking cars in front of him on the road.

A 9-year-old boy was pinned by the SUV and was declared dead at the scene of the accident by arriving medical personnel. Three other people — a 5-year-old boy, a 10-year-old girl and a 47-year-old woman — were also struck and suffered injuries described as non life-threatening. They were all taken to a local hospital. Both drivers remained at the scene and cooperated with the police investigation.

The tragedy of this fatal accident is underscored by the young age of the victim. While New York police do not suspect criminal behavior led to the crash, it is still possible that carelessness played a role. The deceased victim’s next-of-kin as well as the injured parties may wish to pursue wrongful death or personal injury lawsuits, as the case may be, against any party whose negligence is deemed to have caused or substantially contributed to the fatal accident. Such suits would be overseen by civil court authorities as opposed to the criminal justice system.
