A woman is dead following an accident in East New York, according to local sources. The New York woman was apparently killed by an out-of-control car that caused a serious car accident. Police are still investigating the cause of the accident, and so far, no charges have been filed.
The accident report states that the 51-year-old woman was walking with a 59-year-old man along a sidewalk when the accident took place. A 29-year-old woman attempted to negotiate a turn in her sedan and apparently lost control of the vehicle. The car jumped onto the sidewalk and struck both individuals.
The woman was pinned under the vehicle and dragged some distance. She was rushed to a local hospital with severe injuries and later succumbed. The condition of her male companion is not known at this time. Apparently the vehicle responsible for the accident stayed at the scene, and the driver was cooperative with police, who have said they do not believe the act was intentional. Their investigation is ongoing into this matter, however.
Regardless of the cause of the car accident, the fact remains that a woman is dead and another person may be in serious condition. New York traffic laws dictate that the onus for such an accident is typically on a driver, especially when the pedestrians were not even in the street at the time of the crash. Even if police do not charge this woman with a criminal act, the family of the deceased woman will be entitled to file a wrongful death against her, possibly citing negligence or recklessness, depending on the outcome of the police investigation.
