At this time of the year, New York roads carry significantly more traffic than usual. Unfortunately, this is also a time when more drivers who are under the influence of alcohol take to the roads. A fatal car accident that occurred in Flushing is believed to have been caused by a drunk driver.
The New York City Police Department reported that a 29-year-old Island Park resident lost control of his vehicle in the early morning hours of a recent Friday. The out-of-control vehicle reportedly smashed into the rear of an unattended bus. The parked bus was in front of an elementary school.
The driver of the car was transported to the New York Hospital of Queens with injuries that were not thought to be life threatening. Sadly, the passenger in the car was less fortunate. She was killed in the crash, and her death was declared at the accident scene. The accident remains under investigation, and it was reported that the driver was charged with driving while intoxicated.
If a loved one is lost in a car accident that resulted from the negligence of a drunk driver, the surviving family members are free to pursue litigation against the driver. This is true even if the deceased person was a passenger in the car of the intoxicated driver. As long as negligence can be established, a wrongful death claim may be filed in a New York civil court. All documented financial and emotional losses will be considered by the court once liability is proved by appropriate evidence.
